These Terms and Conditions define the rules for using the website available at: Towasze.Studio (the “Service”).
The operator of the Service and the creator of the digital products offered therein is: Szymon Poźniak UI/UX Studio, Poland (NIP/VAT: PL5492469537), trading as Towasze Studio (the “Operator”).
The Service enables users to review the offer of digital products, including website templates and graphic designs, as well as to be redirected to external Sales Platforms enabling their purchase.
Service – the website available at Towasze.Studio, operated by the Operator.
Operator – Szymon Poźniak UI/UX Studio, 32-608 Osiek, Poland (NIP/VAT: PL5492469537), trading as Towasze Studio, the entity operating the Service and the creator of the Products offered therein.
User – any person using the Service.
Buyer – a User who purchases a Product via an external Sales Platform.
Products – digital products created by the Operator:
a) website templates intended for use in Webflow or Framer systems (“Templates”),
b) graphic designs created in Figma (“Figma Projects”),
c) packages comprising Templates and Figma Projects.
Sales Platform – an external online platform enabling the purchase of Products:
a) Lemon Squeezy – a sales platform acting as a Merchant of Record and handling the payment process, invoicing and any refunds,
b) Webflow Marketplace – a sales platform operated by Webflow Inc.
License – a non-exclusive license to use the Products granted to the Buyer by the Operator under the terms set out in the document “Product License”.
Terms and Conditions – these Terms and Conditions of the Service.
Products presented in the Service may be purchased only via external Sales Platforms.
The purchase of Products may take place through the following paths:
a) via the Service
After clicking the purchase button available in the Service (e.g. “Buy on Webflow”, “Buy on Framer” or a similar button), the User is redirected to an external checkout process operated by Lemon Squeezy, through which payment is made and the purchase transaction is concluded.
Through this path, the following may be purchased:
• Templates intended for use in Webflow,
• Templates intended for use in Framer,
• Figma Projects,
• packages comprising the above Products.
b) outside the Service
Products may also be available on external online platforms, in particular:
• Webflow Marketplace – where the User can review the Product and purchase it in accordance with the terms of that platform,
• Framer Marketplace – where the User can review the Product and then be redirected to a checkout process operated by Lemon Squeezy
In the case of purchasing a Product via Lemon Squeezy, the sales agreement is concluded between the Buyer and the operator of that platform acting as Merchant of Record. That platform is responsible for handling the transaction, including payments, invoicing and any refunds.
In the case of purchasing a Product via Webflow Marketplace, the sales agreement is concluded in accordance with the rules applicable on that platform.
The Operator is the creator of the Products and grants the Buyer a license to use them under the terms set out in the Terms and Conditions and in the license document.
The technical conditions of purchase, payment and delivery of Products may be specified in the terms and conditions of the relevant Sales Platform.
The Products constitute digital content.
Due to the nature of the Products as digital content, a Buyer who is a consumer is not entitled to withdraw from the contract after the purchase has been made if the performance has begun with the consumer’s express consent before the expiry of the withdrawal period and after being informed of the loss of the right of withdrawal.
The technical conditions of purchase and the method of fulfilling information obligations required by law are determined by the terms and solutions applied by the relevant Sales Platform through which the Product was purchased.
The Operator does not provide refunds for purchased Products. In exceptional cases, the Operator may decide to grant a refund. Such refund is technically processed by the relevant Sales Platform handling the transaction.
The scope of the license for the Products is defined in a separate document “Product License” available at: towasze.studio/legal/license
The Buyer obtains a non-exclusive Single-Use license allowing the use of the Product in one project.
These Terms and Conditions do not constitute a transfer of economic copyrights (copyright ownership) to the Products.
The Operator may provide technical support with regard to issues directly resulting from the functioning of the Product as a digital product.
Support is auxiliary in nature and does not constitute part of the main service consisting of granting a license to the Product.
Support does not include configuration of Webflow or Framer platforms, integration with third-party tools, or modifications exceeding the standard scope of the Product.
Products are provided on an “as is” basis, subject to mandatory consumer protection laws.
The Operator does not guarantee compatibility of the Products with all tools, plugins, services or solutions of third parties.
The Operator shall not be liable for the manner in which the Buyer uses the Products or for the results achieved using them.
In relation to Buyers acting in the course of their business activity (including sole traders, partnerships, and companies), the Operator’s liability is limited to the amount paid for the given Product
Liability under statutory warranty (implied warranty) is excluded with respect to Buyers acting in the course of their business activity, including sole traders, partnerships, and legal persons.
The exclusions and limitations of liability do not affect consumer rights arising from mandatory provisions of law.
Complaints regarding the Products, in particular their compliance with the description, should be submitted to the Operator at the following email address: hello@towasze.studio
Complaints are reviewed by the Operator within 30 days from the date of their receipt.
The Operator examines substantive complaints regarding the Products and decides on their validity.
The Operator does not technically handle the payment process and does not process refunds.
Payment-related matters and any refunds are handled by the relevant Sales Platform through which the Product was purchased.
All economic copyrights to the Products are held by the Operator.
The purchase of a Product does not result in the transfer of economic copyrights to the Buyer.
The Buyer acquires a license to use the Product under the terms specified in the “Product License” document.
Use of the Products in violation of the license terms constitutes an infringement of the Operator’s economic copyrights.
The Operator may amend these Terms and Conditions for legal or organizational reasons.
The amended Terms and Conditions shall become effective on the date indicated in their updated version published in the Service.
Polish law shall apply to the use of the Service and to the licenses granted for the Products.
The provisions of these Terms and Conditions do not exclude or limit consumer rights arising from mandatory provisions of law.
